Smart Transfer's (TAXI TRANSFER)Regulations:
1. General Provisions
1.1 The terms used in the Regulations should be understood:
a) Purchaser - a person using the taxi transport service, hereinafter referred to as "transfer".
b) Contractor - PIOTRANS Piotr Misztal company, 32-310 Zalesie Golczowskie, 68 Górna St. that performs transfers based on permits and licenses issued by competent public administration authorities.
c) Reservation confirmation – statement of the Contractor about accepting the order from the Purchaser sent by e-mail or by SMS, at a specified date and for a fixed price.
d) Contract of carriage - agreement concluded between the Contractor and the Purchaser at the time of booking; on its basis, the Contractor undertakes to perform the transfer for a specified payment of the ordering person and his luggage from the selected place to the destination indicated in the order.
1.2 Making a booking for a transfer means signing a contract and accepting the provisions of these Regulations.
2. Booking and Purchase of a Service
2.1 Transfers should be booked at least 12 hours in advance, unless the Contractor allows to shorten this time.
2.2 Transfer can be booked via the Internet or by phone via the Contractor's helpline only after prior arrangement with the Contractor if the given date is available.
2.3 It is the Purchaser's obligation to provide a valid phone number (including area codes).
2.4 The Purchaser assumes full responsibility for the data provided to the Contractor's helpline operator during the phone reservation and is responsible for sending the message with the correct reservation (day, route, time, address, telephone number) via e-mail: This email address is being protected from spambots. 2.5 The Contractor accepts payments in cash or by card directly to the driver, only in the case of a reservation made by the Purchaser who has already used the services of the Contractor. The price is set individually between the Contractor and the Purchaser.
2.6 Due for the first transfer can be transferred by the new customer to the Contractor's account: mBank 03 1140 2004 0000 3202 7415 9265 or Dotpay - Settlement of transactions by credit card and e-transfer is carried out via the Dotpay Settlement Center.
2.7 Please make thoughtful reservations and purchases of services.
3. Journey
3.1 The Purchaser should arrive at the address indicated in the order (not applicable to airport pickups) no later than maximum 10 minutes after the set time. If the driver can not contact the Purchaser or wait longer for the Purchaser, he has the right to drive away without informing the Purchaser. Such a situation relieves the Contractor from liability for the situation and does not entitle the Purchaser to claim any compensation or refund for this.
3.2 The Purchaser is obliged to comply the regulations that apply in transport and to comply the recommendations of the driver of the vehicle.
3.3 The Purchaser is responsible for the damages caused to the Contractor (including in particular the destruction of the car) and to other passengers on the general principles provided for in the Civil Code.
3.4 If the car is equipped with seat belts, the Purchaser is obliged to use these belts during the journey.
3.5 The Purchaser is covered by insurance against consequences of unfortunate accidents (called in Poland for short NNW) of the Contractor. The insurance covers only situations that may occur during the Purchaser's stay in the vehicle. Other random events that cause the Purchaser's damages caused outside the vehicle are not covered by this insurance.
3.6 The driver has the right to prevent the Purchaser from taking a seat in the vehicle or to refuse further carriage without the need to refund the costs incurred by the customer in connection to the journey, if the Purchaser:
a) does not comply with the provisions of these Regulations,
b) is in the state indicating the consumption of alcohol or intoxicants (eg: drugs),
c) behaves in a way that is cumbersome for co-passengers and / or for the driver. The legal consequences of the events mentioned in the first sentence shall be borne by the Purchaser. If the Contractor uses the rights referred to in this point, the Purchaser is not entitled to demand compensation for this.
3.7 In vehicles is forbidden to drink alcoholic beverages and other intoxicants, as well as smoking.
3.8 The Contractor shall make every effort to carry the Purchaser and his luggage in a timely manner, in accordance with the agreed time of passage, but for reasons beyond his control, he can not guarantee it (weather conditions, road conditions, unforeseen car breakdown).
3.9 In special cases (change of flight time, change of check-in time due to increased passenger traffic or security reasons, forecasted bad weather) the Contractor reserves the right to refuse to change the departure time or place indicated in the order due to lack of available dates. Possible changes can be reported within 6 hours before the trip but not necessarily accepted by the Contractor. The Contractor guarantees that any new departure time (determined by the Contractor) from the place indicated in the order will be adapted to the direction chosen by the Purchaser and will allow to carry out check-in and passport check-in on a date compliant with the airline's requirements. The Purchaser has the right to refuse to use the service due to the changed departure time. In this case, he is entitled to a refund of the paid amount minus the reservation cost - 50% of the total transfer price.
3.14 When picking up from the airport, the car will come no later than 15 minutes after the scheduled landing time.
3.15 In case of a delay (over 15 minutes) of the arrival of the aircraft, the car is waiting for passengers with a reservation, or a replacement car will arrive as soon as possible. The Purchaser's longer waiting time, which is caused by the above situation, entitles him to resign from the transfer, but without the possibility of refundation of costs.
3.16 Contamination of the upholstery that requires washing it is 500 PLN.
4. Cancellations and Refunds
4.1 In case of cancellation of the reservation of the transfer earlier than 24 hours before the planned departure time or planned arrival, the Purchaser has the right to a refund of the transfer fee reduced by the cost of booking: Booking cost: 99 PLN or 199 PLN;
4.2 In case of cancellation of the reservation of the transfer 24 or at least 6 hours before the scheduled time of departure or planned arrival, the Purchaser has the right to a refund of the transfer fee reduced by the cost of booking:
- Transfer from 1 PLN to 400 PLN - booking cost 99 PLN;
- Transfer over 401 PLN - booking cost 199 PLN;
4.3 In case of cancellation of the reservation of the transfer less than 6 hours before the scheduled time of departure or planned arrival, the Purchaser is not entitled to a refund of the transfer fee.
4.4 If failure to carry is caused by the Contractor, for reasons other than described in these regulations, the Purchaser is entitled to a full refund of the amount paid to the Contractor.
5. Luggage
5.1 Each piece of luggage carried in the trunk should be described by the owner's name and surname. It is the passenger's responsibility to mark the baggage.
5.2 The amount of luggage over the limit should be discussed in advance with the Contractor (stroller or wheelchair, sport equipment, bicycles, etc.).
5.3 Each passenger has the right to carry one suitcase up to 32 kg and one hand luggage up to 5 kg.
5.4 The driver has the right to refuse to take luggage if it does not meet the requirements set out in these Regulations.
5.8 For items left in the car because of forgetfulness or for other reasons, the Contractor is not responsible and does not protect them.
6. Complaints
6.1 Complaints that result from the contract of carriage should be sent to the address of the Contractor (Piotrans Piotr Misztal, 32-310 Zalesie Golczowskie, 68 Górna St.) only in writing and no later than 30 days from the occurrence of circumstances that are the subject of the complaint. The person authorized to file a complaint is the Purchaser or its legal guardian. Complaints submitted by third parties are not considered.

6.3 The carrier considers complaints within 14 days from the date of delivery.
7. Security Policy Regarding Personal Data
7.1 In accordance with the Personally Identifiable Information Protection Act of August 29, 1997 (Journal of Laws 1997 No. 133, with later amendments), the Contractor ensures protection of all personal data that has been obtained as a result of the service activities and the execution of orders on its website.
7.2 The Contractor ensures that the personal data of Purchasers are processed only for the purpose of carrying out orders.
7.3 The Purchaser has the right to request supplementing, updating, rectifying personal data, temporary or permanent suspension of their processing or their removal if they are incomplete, out-of-date, untrue or have been collected in violation of the law or are no longer necessary to achieve the purpose for which they were collected, and also has the right to submit a written request to cease the processing of his personal data.
7.4 The Contractor will not share data about Purchasers and passengers and services purchased by them with other entities.
8. Final Provisions
In matters not regulated by these Regulations, the following provisions shall apply: the Act of April 23, 1964 - the Civil Code (Journal of Laws of 1964 No. 16, item 93, with later amendments).
